General Conditions

Article 1 – Definitions

In these Terms and Conditions, the following definitions apply:

  • Withdrawal Period: The period within which the consumer may exercise the right of withdrawal.

  • Consumer: A natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.

  • Continuous Contract: A distance contract relating to a series of products or services whose delivery or performance is spread over time.

  • Right of Withdrawal: The consumer’s right to cancel the distance contract within the withdrawal period.

  • Entrepreneur: A natural person or legal entity that offers products or services to consumers at a distance.

  • Distance Contract: An agreement concluded between the entrepreneur and the consumer through remote communication methods.

  • CESOP: The centralized electronic system implemented by the EU to monitor payment service providers.

Article 3 – Scope

These Terms and Conditions apply to all offers made by the entrepreneur and all distance contracts concluded between the entrepreneur and consumers. The terms are provided electronically or otherwise before the conclusion of any contract.


Article 4 – Offers

  • All offers are non-binding. The entrepreneur reserves the right to change offers at any time.

  • Each offer clearly states the total price, including shipping costs, duties, and any additional charges imposed by postal or courier services.


Article 5 – Contract

The contract is concluded once the consumer accepts the offer and fulfills the stated requirements. The entrepreneur will confirm acceptance promptly via email.


Article 6 – Right of Withdrawal

  • The consumer has the right to cancel the contract within 14 days of receiving the product, without providing a reason.

  • Return shipping costs are the responsibility of the consumer when exercising the right of withdrawal.


Article 7 – Costs of Withdrawal

The entrepreneur will refund all payments within 14 days of withdrawal, provided that the product is returned in its original condition.


Article 8 – Customs, Import Duties, and VAT

8.1
All products sold via the website are delivered under Incoterms 2000: Delivered Duty Unpaid (DDU). The customer is solely responsible for all import-related costs and obligations.

8.2
These obligations include but are not limited to:
(a) payment of customs duties, VAT, GST, and other taxes;
(b) customs clearance fees, such as handling or inspection charges imposed by customs, postal services, or couriers;
(c) compliance with local laws, product regulations, and certification requirements in the destination country.

The entrepreneur does not act as the official importer of record. Ownership and responsibility transfer to the customer upon shipment. The entrepreneur is not liable for delays, seizures, or penalties arising from the customer’s failure to comply with import requirements.

8.4
The entrepreneur will include necessary documentation with international shipments (e.g., pro forma invoice, product description, declared value). However, no guarantee is given that these documents or the products themselves meet local technical or regulatory import requirements.

8.5
The customer agrees to indemnify and hold the entrepreneur harmless from any financial consequences or claims resulting from non-compliance with import regulations.

Customers are advised to contact their local customs authorities before placing an order to avoid unexpected charges or delivery issues.


Article 9 – Compliance with CESOP Regulations

As of 2024, payment service providers register transaction data in the CESOP system under EU regulations. The entrepreneur complies with these regulations, which may affect payment monitoring and reporting.


Article 10 – Conformity and Warranty

  • The entrepreneur guarantees that products conform to the contract and statutory requirements.

  • Any defects must be reported in writing within 14 days.

  • Products must be returned in their original packaging and condition.


Article 11 – Delivery

  • Orders will be delivered within 30 days, unless otherwise agreed.

  • If delays occur, the customer will be informed within 14 days of placing the order.

  • Products are delivered under the condition that the customer assumes responsibility for import processes.

  • The entrepreneur complies with international shipping regulations but is not responsible for delays or issues caused by customs authorities.

  • Failure by the customer to meet import obligations is not a valid reason for cancellation or refund.


Article 12 – Complaints

  • Complaints must be submitted in writing within 7 days of identifying the issue.

  • The entrepreneur will respond within 14 days. If resolution requires more time, an estimated timeframe will be provided.


Article 13 – Disputes

  • These Terms and Conditions are governed by the laws of the Netherlands.

  • Disputes should first be resolved amicably. If this is not possible, disputes will be submitted to the competent court in the Netherlands.
